FDA Warns CBD Companies Over Unproven Healthcare claims
The warnings issued by FDA are the repercussions of the increasingly advertised products claimed to treat cancer and other serious diseases.
“Charlotte’s Web”-a Colorado-based company-also finds its way into the pool of four companies who are notified by the FDA.
The rest of three companies are CW Hemp (Stanley Brothers Social Enterprises LLC), That’s Natural Marketing & Consulting, Green Roads Health, and Natural Alchemist.
The statement issued by the FDA stresses on their cause of eliminating any false claims by these companies that are targeting people suffering from serious illnesses.
Quoting this concept, the FDA Commissioner Scott Gottlieb, M.D said, “Substances that contain components of marijuana will be treated like any other products that make unproven claims to shrink cancer tumors. We don’t let companies market products that deliberately prey on sick people with baseless claims that their substance can shrink or cure cancer and we’re not going to look the other way on enforcing these principals when it comes to marijuana-containing products.”
The warning letter sent to the afore-mentioned companies stated that FDA would not approve of any false claims about drugs including those which term CBD-rich products as dietary supplements.
The indication of this action was already given in October when the Commissioner stated his resolve against the marijuana products producing companies who are said to have “anti-tumor effects” in “setting of cancer.”
The letters that were sent to the companies contain the claims that are made by them and that are considered illegal by the FDA.
For example, That’s Natural was warned about the testimonials that are on their website about CBD products curing cancer, CW Hemp was instructed about their answers to the customers which state that there is no need of an RX for purchasing Charlotte’s Web products.
Other two companies were also presented with citations of their false claims and a need to stop them.
However, if they fail to do so, the warnings will be extended to legal actions against the perpetrators.
There are some considerations brought under the understanding when deciding to send warning letters to companies. In an email to The Cannabist, Michael Felberbaum, FDA spokesperson said, “When a product is in violation of the Federal Food, Drug, and Cosmetics Act, the FDA considers many factors in deciding whether or not issue warning letters. Those factors include, among other things, agency resources and the threat to the public health.”
To counter these warning, the companies sought legal help, according to Bob Hoban who is the managing partner at Hoban Law Group. The attorney specializes in laws concerning cannabis. He also said that the warnings should be taken seriously and the companies should have a check of their claims.
However, the attorney does not approve of is the FDA’s opposition to the CBD companies’ position over the products terming them dietary supplements, and also suggests that the manufacturers of CBD-rich extracts must make sure that they fall under the category of dietary supplements.
